Scope

 

The General Terms and Conditions (hereinafter referred to as “Terms and Conditions”) apply to all orders and contracts concluded (hereinafter referred to as “Order”) via the online shop Novalia USA.ch (hereinafter referred to as “Novalia USA”). Which is part of the company PYROS MEDIA GmbH.

 

Novalia USA reserves the right to change the terms and conditions. The version of the General Terms and Conditions valid at the time of the order is decisive, which cannot be changed unilaterally for this order.

 

Offer

 

The offer is aimed at natural customers with residence or legal clients based in Switzerland. Deliveries are only made to addresses in Switzerland.

 

The offer is valid as long as it is visible in the online shop and/or stocks last. Price and range changes are possible at any time. The images shown in the online shop and all information about the products are for illustration purposes and are non-binding.

 

Price

 

Prices are in Swiss francs, including value added tax (VAT). The price in the online shop at the time of ordering is decisive.

 

Order

 

The presentation of the products in the online shop is not a legally binding application, but rather a non-binding online catalog or a non-binding invitation to customers to order the product in the online shop.

 

An order is considered an offer to Novalia USA to conclude a contract.

 

A minimum order value applies per order. The minimum order values communicated in the online shop and the delivery cost guidelines apply.

 

After submitting the order, the customer automatically receives a confirmation of receipt documenting that the order has been received by Novalia USA.

 

Novalia USA is free to reject orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded; in particular, products that cannot be delivered will not be forwarded. Products that are temporarily unavailable cannot be reserved.

 

Processing fee

 

Novalia USA reserves the right to charge a processing fee of up to CHF 25.00 for changes of any kind to the order, cancellation within 6 hours of the order time or in the event of a return that has not been agreed upon.

Payment options

 

Payments must be made in Swiss francs.

 

The available payment methods are displayed in the online shop.

 

Conclusion of contract

 

A contract is only concluded when Novalia USA processes the order. As soon as the order has been prepared for shipping, the customer will receive an order confirmation by email.

 

Delivery

 

The customer's delivery address must be in Switzerland.

 

No deliveries are made on weekends or official national or cantonal holidays.

 

If the customer is not on site at the time of delivery and has not given any special delivery instructions, the delivery courier will leave a collection invitation in the mailbox. The customer must then collect the delivery from the relevant post office.

Any order that is not collected within the stated deadlines cannot be held or refunded. The customer bears sole responsibility for orders picked up late and any claims for defects are excluded.

 

Customers will be asked to additionally confirm their pickup with their signature. Any liability for damages incurred by the customer due to loss, theft, misuse, etc. in connection with the collection process or the collection slip is expressly excluded.

 

The customer assumes responsibility for the delivered products, even if they were not received directly by them.

 

The buyer is responsible for any customs duties.

 

Delivery costs

 

The delivery costs depend on the quantity of products ordered. The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.

 

Warranty

 

Novalia USA can provide the warranty either through partial or complete replacement with an equivalent product.

 

Return of defective goods

 

The buyer bears the costs of returns. Returns must be agreed in advance with Novalia USA (contact@Novalia-USA.com).

 

Notification of defects

 

If products are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the delivery courier and refuse acceptance, without prejudice to their rights to defects. The customer is obliged to obtain a damage confirmation report from the delivery courier. All transport damage must also be reported to Novalia USA immediately.

 

It is also the customer's responsibility to check the ordered products immediately upon receipt. For any defects or deviations from the order, Pet Land customer service must be notified by email contact@Novalia-USA.com on the day of delivery. Novalia USA reserves the right to require proof of the defect.

 

Transfer of risk

 

The risk passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If shipping is delayed or becomes impossible through no fault of our own, the risk is transferred to the buyer upon notification of readiness for shipping. An agreed assumption of transport costs by Pet Love in individual cases has no influence on the transfer of risk.

 

Limitation of Liability

 

Claims for damages arising from impossibility of performance, from breach of contract, from negligence in concluding the contract and from unlawful acts are excluded against us as well as against our vicarious agents or vicarious agents, unless there is intentional or grossly negligent action. Any liability for consequential damages resulting from the use of the products is rejected.

 

Applicable Court and Venue

Pfäffikon ZH is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
